Ordering & Delivery Policy

ORDERING FROM US

  • You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.

  • Our acceptance of an order takes place when we dispatch the order. When we dispatch the order the purchase contract will be made , unless we have notified you that we do not accept your order or you have cancelled your order.

  • All orders are subject to acceptance by ‘Plant Lovers Garden”, and any of its personnel, reserve the right, at our discretion, to reject any order without giving reasons. In the event of rejection, we will refund any payments in full, via the payment method used to place the order. We may refuse to accept an order: 

(a) where goods, services or information ordered by you are not available; 

(b) where we cannot obtain authorisation for your payment; 

(c) if there has been a pricing or product description error; or 

(d) if you do not meet any eligibility criteria set out in our terms and conditions. 

(e) if we do not deliver to your area; 

  • Where we do not accept your order but have processed your payment, we will re-credit your account with any amount deducted by us via your original payment method, but in any event within 30 days of your order. We will not be obliged to pay any additional amount as compensation for disappointment.

  • If you wish to cancel or change your order, please email us at plantloversgarden@outlook.com. We will always do our best to make last minute changes for you, but we cannot guarantee that any changes will be auctioned before your order is processed.

PRICING

  • Our prices do not include VAT as we are not registered for VAT. 

  • Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website. 

  • Our prices are reviewed periodically.

  • Special offers and promotions - We reserve the right to end any special offers, discounts and promotions at anytime without prior notice and special offers, discounts and promotions may not be applied retrospectively.

 

DELIVERY

  • We will deliver goods ordered by you as soon as possible to the address you give us for delivery, usually within 7 days of ordering but in any event within 30 days of your order unless otherwise specified at the time of order acceptance.

  • We cannot guarantee that delivery instructions will be followed.

  • If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by email, of the problem within 5 working days of the delivery of the goods in question.

  •  In the event of a non-delivery (plants that have not arrived 2 days after their intended delivery date), please contact us at plantloversgarden@outlook.com. It is the customer’s responsibility to contact us within 7 days of the schedules delivery date in order to claim a refund. Failure to do will result in the lapse of any right to a refund.

  • If our carrier is unable to deliver your goods after making reasonable efforts and a safe place for your goods to be left has not been advised to us or is not available, you may be charged for the return of the goods to us, should a charge be applied.

  • We can not be held responsible for deliveries that are delayed due to wrong or incomplete address details given to us or for the condition of the goods due to delays of this nature.

  • Where delivery is requested by a customer to a Pick-up Shop it is the responsibility of the customer to provide the required proof of identity. In the event that goods are returned to sender the cost of delivery and return will not be refunded.

  • Plant Lovers Garden only delivers within the United Kingdom apart from the following exclusions:

Channel Islands

Isle of Man

Scottish Highlands

Northern Ireland

Isle of Wight

Scilly Isles

Scottish Isles

LIABILITY

  •  If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by email, of the problem within 5 working days of the delivery of the goods in question. 

  • If you notify a problem to us under this condition, our only obligation will be, at your option: 

  • (a) to make good any shortage or non-delivery; 

  • (b) to replace or repair any goods that are damaged or defective; or 

  • (c) to refund to you the amount paid by you for the goods in question in whatever way we choose. 

  • Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.

  • You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase. 

  • Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

SPECIAL OFFERS AND PROMOTIONAL CODES

  • At our discretion, from time to time, we may offer promotional codes or products at discounted prices. These offers are valid from the time that we introduce them to the end date of the offer, and they cannot be used for purchases before the offer induction date or after the offer date end.

  • In the event that a customer has made a purchase and the price of the product falls or is discounted due to a special offer, the price of the product at the time of the purchase shall prevail. We are unable to offer special discounts for purchases that have already been made.

  • Unless explicitly expressed otherwise, free or discounted introductory offers are only available to new users and are only available once to any one household.

  • A special offer or promotional code cannot be used in conjunction with any other special offer or promotional code.

  • Only one promotional code may be used per order.

  • We reserve the right to offer personalised special offers and promotions which will only be redeemable by the customer in receipt of the special offer.

  •  Unless stated otherwise, promotional codes cannot be redeemed against or applied to orders placed during key peak periods where supply is limited.

REFUNDS, CANCELLATION OF CONTRACTS FOR GOODS AND RETURNS POLICY – FOR CONSUMERS ONLY

  • This section applies to consumers only (and not to businesses or other organisations) who order goods

  • If you ever have a problem, please get in touch via our email and we will get back to you as soon as we can.

  • While we do our best to ensure that the plants arrive in perfect condition, on a small number of occasions (for reasons beyond our control) they may arrive damaged. If the recipient receives damaged plants, please notify us and email a photograph of the damage within 24 hours of receipt.

  • In the event an order is cancelled before dispatch but after the dispatch date is agreed or email shipment acknowledgement has been sent and plants have been prepared for dispatch and reserved, a restocking charge may be applied.

  • All plant products are subject to availability. We reserve the right, at our absolute discretion, to substitute any product with an alternate product of a similar style and equivalent (or greater) value and quality.

  • The provisions of this clause do not affect your statutory rights.

 CIRCUMSTANCES BEYOND OUR CONTROL

  •  It is possible that errors may occur within our system, due to unseen circumstances. While we take every precaution to ensure our systems run without fault, if problems do occur, we will endeavour to fulfil all orders on the requested dates. However, if this is not possible, we shall contact the customer to either refund or rearrange the order.

  •  Force Majeure: Neither Plant Lovers Garden,  nor any courier service that we use, shall be liable for any failure to perform any obligations if the delay results from any of the following but not limited to: acts of God, outbreaks of hostilities, riot, civil disturbances, acts of terrorism, the act of any government or authority, fire, explosion, flood, adverse weather, power failure, failure of telecommunication lines; failure or breakdown of plant, machinery or vehicles; default of suppliers, sub-contractors or delivery partners, theft, malicious damage, strike, lock-out or industrial action of any kind and any cause or circumstance beyond our reasonable control.

  • During adverse weather conditions (including, but not limited to heavy snow, ice, high winds, flooding) our delivery services may not be able to deliver.

SERVICE ACCESS

  • While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period. 

  • Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

ABUSIVE BEHAVIOUR

  • We will not tolerate abusive behaviour of any kind. If anyone is abusive to any of our staff, we will terminate all contact and will not resume unless the dialogue is in a non-abusive fashion. We reserve the right to not do business with returning customers who were abusive in the past.

REGISTRATION/SUBSCRIPTION

  • To register with www.plantloversgarden.com you must be over 18 years of age. 

  • Each registration is for a single user only, whether or not acting on behalf of a company or other organisation. We do not permit you to share your user name and password with any other person nor with multiple users on a network. 

  • Responsibility for the security of any passwords issued rests with you and if you know or suspect that someone else knows your password, you should contact us immediately. 

  • We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.

Your purchase will be deemed to have occurred in the UK if the delivery was to an address in the UK. In the event of a delivery to an address in the UK, these Terms and Conditions shall be governed by and construed in accordance with English and Welsh Law and the parties agree to submit to the exclusive jurisdiction of the English and Welsh courts.
